These Terms and Conditions (“Terms”) govern your use of atlanticeye.com and your participation in electronic communications from Atlantic Eye Physicians, P.A., doing business as Atlantic Eye (“Atlantic Eye,” “we,” “us,” or “our”). By using our website, you agree to these Terms. Your receipt of text messages or emails is also subject to the consent and preference choices you provide to Atlantic Eye.

Website Information Is Not Medical Advice

Website content is provided for general educational and informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment. Use of this website or electronic communications does not by itself create a physician-patient relationship.

Do not use the website, email, or text messaging for a medical emergency. If you are experiencing a medical emergency, call 911. For an urgent eye problem, call Atlantic Eye directly at (732) 222-7373.

SMS Terms of Service

If you provide a mobile telephone number and opt in to text messaging, you agree that Atlantic Eye may send text messages to that number, which may be delivered using automated technology. You may receive text messages that include appointment reminders, scheduling updates, billing notifications, and other relevant information related to your care. Message frequency may vary. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Your consent to receive text messages is voluntary and is not a condition of receiving care or purchasing goods or services from Atlantic Eye.

You may opt out of receiving text messages at any time by replying STOP. We also honor other reasonable requests to stop messages when communicated to us. After opting out, you may receive one final message confirming your request. To receive text messages again, contact Atlantic Eye or complete a new opt-in process.

You are responsible for providing an accurate mobile number and for notifying Atlantic Eye if the number changes or is reassigned. Not all mobile devices or carriers may be supported.

Email Communications

You may receive email communications related to scheduling, billing, and other healthcare operations if you provide an email address and select or otherwise provide the applicable communication preference. You may opt out of certain email communications by using any available unsubscribe link, changing your preferences, or notifying our office. You may also opt out of electronic communications by notifying our office in writing. Opting out of optional emails does not prevent Atlantic Eye from sending communications that are necessary for treatment, payment, healthcare operations, safety, or legal compliance when permitted by law.

Communication Preferences

When presented on a demographic, intake, consent, or other Atlantic Eye form, you may indicate one or more of the following preferences. Merely reading these Terms does not enroll you in a communication program; your selections on the applicable form or through another Atlantic Eye opt-in process determine your preferences.

  • I agree/opt in to receive appointment and scheduling notifications via text at the contact information provided on my demographic form. Message and data rates may apply. Msg freq varies, reply STOP to cancel.
  • I agree/opt in to receive appointment and scheduling notifications via email at the contact information provided on my demographic form.
  • I agree/opt in to receive billing statements via text and/or email.
  • I agree/opt in to receive PHI electronically if requested.
  • I decline to receive electronic communications.

You may update these preferences by contacting Atlantic Eye. If you decline or later opt out of electronic communications, Atlantic Eye may use another permitted method to contact you when necessary.

Privacy and Security of Electronic Communications

Standard text messages and emails may not be encrypted. Although Atlantic Eye uses reasonable safeguards and seeks to limit sensitive information in electronic communications, there is a risk that a message could be intercepted, viewed by someone with access to your device or account, sent to the wrong person, or otherwise disclosed. By requesting electronic transmission of PHI, you acknowledge these risks and authorize Atlantic Eye to communicate through the requested method to the extent permitted by law and Atlantic Eye policy.

Do not send highly sensitive medical, financial, or identifying information by standard text message or email unless Atlantic Eye specifically instructs you to do so. Electronic messages may not be reviewed immediately and should not be used for emergencies or time-sensitive medical concerns.

Acceptable Website Use

You agree not to misuse the website, attempt to gain unauthorized access to systems or information, interfere with website operation, introduce malicious code, impersonate another person, or use the website in violation of applicable law.

Third-Party Services and Links

The website may contain links to third-party websites or services, including patient portals, payment services, online stores, and social-media platforms. Atlantic Eye does not control and is not responsible for the content, availability, privacy, security, or practices of third-party websites or services. Your use of those services may be governed by separate terms and policies.

Intellectual Property

Unless otherwise stated, website content, branding, graphics, text, photographs, videos, and other materials are owned by or licensed to Atlantic Eye and are protected by applicable intellectual-property laws. You may view and use website content for personal, noncommercial purposes. No other use is permitted without prior written authorization.

Disclaimer and Limitation of Liability

Atlantic Eye seeks to keep website information accurate and current but does not warrant that all content will be complete, error-free, or continuously available. To the fullest extent permitted by law, Atlantic Eye disclaims warranties relating to the website and is not liable for damages arising from use of, or inability to use, the website or third-party services. Nothing in these Terms limits liability that cannot lawfully be limited.

Changes or Termination

Atlantic Eye may update these Terms, change or discontinue website features, or modify or end an electronic communication program at any time. Updated Terms will be posted on this page with a revised effective date. Changes to consent or communication preferences will be handled in accordance with applicable law.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where federal law applies.
